Data Processing Overview

Account Management: We process account and profile data based on contractual necessity. This data is retained until the account is deleted or a request for data erasure is made by the user.
Service Delivery: Location, device, and usage data are processed to deliver our services effectively, grounded in contractual necessity and our legitimate interest in providing an optimized user experience. This data is kept as long as necessary for service provision and is then anonymized or deleted.
Marketing and Communication: We process contact details and usage data for marketing purposes based on user consent and our legitimate interest in promoting our services. This data is retained until the user opts out or deletes their account.

List of Data Processors
A non-exhaustive list of third-party data processors we might engage with includes cloud storage providers (Google Cloud Storage, Firebase Cloud Storage), analytics services (Google Analytics 4, Google Analytics for Firebase, Mixpanel), customer support platforms, payment processing partners, Firebase Authentication, Firebase Cloud Functions, Firebase Cloud Firestore, Firebase Realtime Database, Firebase Hosting, and Firebase Cloud Messaging for push notifications. We ensure all processors are compliant with data protection laws and uphold the same standards of data security as Globout.
Additional Information
Trackers and Diagnostics: We employ trackers for usage data analysis and diagnostics for crash data to enhance service reliability and user experience. This data is not linked to individual users.
Permissions: The app requests various permissions for functionality including contacts, camera (with and without saving or recording), photo library, and location (precise and ongoing, both continuous and non-continuous). User identification is managed via a universally unique identifier (UUID).
Third-party Services: Our services integrate with Google services (Google Analytics, Google Big Query, Google Ireland Limited, Google Looker Studio), the App Store, and Google Play Store, ensuring equal protection of user data. Our mailing list is managed through Sendgrid.
Public Profiles and Pseudonym Use: Users have the option for public profiles and the use of pseudonyms to enhance privacy and user experience.

These Terms of Service (“Terms”) govern your access to and use of our services (“Services”), provided by Globout UG (haftunsgbeschränkt) ("Globout"). These Terms constitute a legally binding contract between you and Globout. We urge you to read these Terms carefully.
Your agreement to these Terms is required to access and use our Services. Acceptance occurs when you first sign up for the Services and subsequently when significant updates are made. If you disagree with any part of these Terms, you will be unable to use our Services.
1. Acceptance and Eligibility
To use our Services, you must agree to these Terms and confirm you meet the eligibility criteria. Our Services are not intended for individuals under 16 years of age. However, those aged between 13 and 16 may use the Services if it's legal in their country of residence. No one under the age of 13 may access the Services. You affirm that you are capable of entering into this contract and will comply with these Terms and all applicable laws and regulations.

2. Account Creation and Use
Creating Your Account
To enjoy our Services, you'll need to create an account. Here’s what you need to know:
One Account Per Individual: Your account is personal and should accurately reflect your identity. This information, along with other profile details, will be public to ensure connectivity within our Services.
Use your actual name and details.
Impersonation is strictly forbidden.
Ensure your information remains accurate.
Creation of new accounts to circumvent bans is not allowed.
Essential Information: Registration requires your name, and phone number for account security verified through a text message.
Phone Number and Verification: A current phone number is critical for account security. We use this for initial verification and essential communications.
Location Services: Accurate location data, both precise and approximate, enhances our Services' functionality, relying on your device's location settings. For full functionality, we'll ask for your device's location during registration. You can manage location settings anytime through your device. Our features depend on location services being enabled.
Contacts and Social Features: We access (but do not store) your contacts to facilitate connections within Globout. You control the privacy settings to manage how much information you share. Standard messaging rates may apply.
Using Our Services
You're granted a non-exclusive, worldwide, royalty-free license to use our Services, provided you adhere to these Terms. This license is intended solely for your personal enjoyment and benefit from the Services.
Notifications: Opt-in to receive updates about interactions, friend activities, and other relevant notifications.
Account Security: Take steps to protect your account and device, maintaining the confidentiality of your personal information.
3. Prohibited Activities and Content License
Prohibited Uses
You agree not to misuse our Services or engage in activities that could harm Globout or other users, or compromise the safety or functionality of our Services or other users' experiences. This includes, but is not limited to, scraping data, infringing on others' rights, violating laws or regulations.
Content Ownership
You retain ownership over the content you create and share on Globout. By using our Services, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, display, and distribute your content as necessary to operate and promote the Services, including through third-party partnerships.
4. Paid Services
Globout offers additional features through our Services, referred to as "Paid Services." The specifics and pricing are detailed within the Services and may vary internationally.
Purchases are processed via the mobile application marketplace corresponding to your device (Google Play for Android or App Store for iOS). Since these platforms manage the purchase process, please review their terms and conditions, especially regarding refunds and withdrawals.
By purchasing a Paid Service, you acknowledge that the service is immediately available, and as such, you waive any right to cancel the purchase or to exercise any withdrawal rights, except as permitted by the marketplace's policies.
5. Privacy and Data Use
As detailed in our Privacy Policy, we collect and use data you provide to us, data generated through your use of the Services, and data from third-party sources. This includes, but is not limited to, account data, profile pictures, location data, and usage data for the purposes of providing, improving, and safeguarding the Services. Our Privacy Policy outlines how we handle and protect your personal data and privacy under these Services. By using Globout, you consent to the data practices described in our Privacy Policy.
6. Service Modifications and Termination
Globout constantly evolves, and we reserve the right to modify, suspend, or discontinue our Services at any time. Notice of any significant changes will be provided where possible. Additionally, Globout may temporarily or permanently terminate or suspend your access to all or part of the Services at any time for violations of these Terms, with or without cause, with or without notice, at our discretion, effective immediately.

Our Services may integrate or offer access to third-party services and content. We are not responsible for the practices of these third-party entities, and they are governed by their own terms and policies. Your interactions with third-party services are not covered by these Terms.
8. Disclaimers and Limitations of Liability
Globout provides the Services on an "as is" and "as available" basis without any warranties, expressed or implied. We do not guarantee that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
Globout and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with these Terms or the use of the Services.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Germany, without giving effect to any principles of conflicts of law. You agree to resolve any disputes you have with Globout exclusively in a state or federal court located in Berlin, Germany, and to submit to the personal jurisdiction of those courts for the purpose of litigating all such disputes.
10. General Provisions
Changes to Terms
Globout reserves the right to modify these Terms at any time. Your continued use of the Services after any such changes take effect constitutes your acceptance of the new Terms. If you do not agree to the new terms, please stop using the Services.
Entire Agreement
These Terms, together with the Privacy Policy and any amendments and additional agreements you may enter into with Globout in connection with the Services, shall constitute the entire agreement between you and Globout concerning the Services.
Waiver and Severability
The failure of Globout to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

End User License Agreement (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Globout UG (haftungsbeschränkt) ("Globout", "we", "us", or "our") for the Globout application software, which includes computer software, mobile applications, and may include associated media, printed materials, and online or electronic documentation (collectively, the "Software").
By installing, copying, downloading, accessing, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.
1. Grant of License
Subject to the terms of this Agreement, Globout grants you a personal, non-exclusive, non-transferable, limited license to install and use the Software on your devices solely for your personal and non-commercial purposes.
2. Restrictions
You shall not:
Copy, distribute, or reproduce the Software in any manner not expressly allowed by this Agreement.
Modify, translate, adapt, or create derivative works from the Software.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Software or any features or functionality of the Software to any third party for any reason.
3. Intellectual Property Rights
The Software is licensed, not sold. This Agreement only gives you some rights to use the Software. Globout retains all other rights. You own the media on which the Software is recorded, but Globout and its licensors retain ownership of the Software itself.
4. Updates and Upgrades
Globout may from time to time provide updates or upgrades to the Software (collectively, "Updates"), but is not under any obligation to do so. Such Updates may be provided automatically or upon your request. Your use of such Updates will be governed by this Agreement unless you are asked to agree to a new agreement at the time of download or installation.
5. Termination
This Agreement is effective until terminated by you or Globout. Your rights under this Agreement will terminate automatically without notice from Globout if you fail to comply with any term(s) of this Agreement. Upon termination, you shall cease all use of the Software and destroy all copies, full or partial, of the Software.
6. Disclaimer of Warranties
The Software is provided "AS IS", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
In no event shall Globout, its directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use or inability to use the Software.
8. Governing Law
This Agreement will be governed by the laws of Germany, without regard to its conflict of laws principles.
9. Entire Agreement
This Agreement constitutes the entire agreement between you and Globout regarding the Software and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
